1. Acceptance of Terms

By accessing or using the Sawtkum platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

Sawtkum provides an enterprise feedback intelligence platform that includes survey creation and distribution tools, form building capabilities, analytics and reporting dashboards, AI-powered feedback analysis, integration services, and related features. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time.

3. Account Registration

To use certain features of the Services, you must register for an account. You agree to provide accurate, current, and complete information during registration, maintain and update your information, keep your password secure and confidential, notify us immediately of any unauthorized access, and accept responsibility for all activities under your account.

4. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law, regulation, or third-party rights
• Send unsolicited or unauthorized communications (spam)
• Collect personal data without proper consent
• Upload malicious code, viruses, or harmful content
• Interfere with or disrupt the Services or servers
• Attempt to gain unauthorized access to any part of the Services
• Use the Services for any fraudulent or deceptive purpose
• Reverse engineer, decompile, or disassemble any part of the Services

5. Your Content

You retain all rights to the content you create using the Services, including surveys, forms, and collected responses ("Your Content"). By using the Services, you grant us a limited license to host, store, process, and display Your Content solely to provide the Services. You are responsible for ensuring Your Content does not violate any laws or third-party rights.

6. Data Processing

When you use the Services to collect data from respondents, you act as the data controller. Sawtkum acts as the data processor. You are responsible for obtaining any necessary consents from respondents, providing appropriate privacy notices, complying with applicable data protection laws, and handling data subject requests. We process data in accordance with our Privacy Policy and any applicable Data Processing Agreement.

7. Subscription and Payment

Paid subscriptions are billed in advance on a monthly or annual basis. Fees are non-refundable except as required by law. We may change pricing with 30 days' notice. If you exceed your plan's limits, you may need to upgrade to continue accessing all features. Free plans are subject to usage limitations as described on our pricing page.

8. Intellectual Property

The Services, including all software, designs, text, graphics, and other content provided by Sawtkum, are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent. The Sawtkum name, logo, and all related trademarks are our property.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROAA.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

Either party may terminate these Terms at any time. You may terminate by closing your account. We may terminate or suspend your access if you violate these Terms. Upon termination, your right to use the Services ceases immediately. We will make your data available for export for 30 days following termination, after which it may be deleted.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Services. Your continued use after changes become effective constitutes acceptance of the updated Terms.
